THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.5608 of 2018 ORDER:
It is the case of the petitioner that he is the absolute owner and possessor of the land admeasuring Ac.1.39 guntas in Survey No.565/1 of Kortikal Village, Mamada Mandal in Adilabad District, having purchased the same under a registered sale deed dated 09.08.2016. His name was being continued in the revenue records till 2016. While so, all of a sudden without any notice to the petitioner, the name of one Smt. P.Laxmi, the fifth respondent, was recorded in the enjoyer column and challenging such entry, the petitioner already preferred an appeal before the third respondent. When the said appeal is pending, he filed the present Writ Petition challenging the proceedings of the fourth respondent dated 29.11.2016 deleting the name of the petitioner from the possessory column in respect of the land of an extent of Ac.1.00 in Survey No.565/1.
The grievance of the petitioner is that his name was continued in the pattadar column as well as possessory column in respect of Ac.0.39 guntas, whereas in respect of the land admeasuring Ac.1.00, the name of the petitioner was continued in the pattadar column, but not in the enjoyer column, where the name of the fifth respondent is included. The petitioner ought not to have filed the present Writ Petition when the
proceedings are pending before the third respondent, pursuant to the appeal preferred by the petitioner.
In the circumstances, the third respondent is directed to consider the appeal preferred by the petitioner against the order of the fourth respondent dated 29.11.2016 and dispose of the same in accordance with law, as expeditiously as possible, but not later than three months from the date of receipt of a copy of this order after issuing due notice to the fifth respondent. In the meanwhile, there shall be status quo with regard to the entries in the revenue records till passing of the said order. The Writ Petition is, accordingly, disposed of.
