ORDER:- Heard.
2. By the present writ petition, petitioner questions the action of the SubRegistrar, fourth respondent, in not registering and releasing the mortgage deed, which was numbered as P.No.909 of 2015.
3. Instructions of the learned Government Pleader, however, show that the fourth respondent has rejected the registration on the ground that survey No.190 is prohibited and passed a refusal order No.26 of 2015.
4. Learned counsel for the petitioner has verified and states that since the said order is likely to be received by the petitioner on 03.08.2015, he may be permitted to approach the appellate authority questioning the said order as petitioner merely wants to register a mortgage deed which can be considered by the appellate authority expeditiously.
5. In view of the subsequent event and since the refusal order is passed by the fourth respondent, I deem it appropriate to dispose of the writ petition permitting the petitioner to approach the second respondent appellate authority if he wishes to question the said refusal order and if such an appeal is filed by the petitioner, the second respondent shall consider and dispose of the same expeditiously as the petitioner's mortgage deed is proposed to be registered by the petitioner as against the loan sanctioned in his favour by the Bank. The second respondent shall therefore expeditiously examine the appeal and pass appropriate order.
With the above direction, the writ petition is disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
