HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 18138 OF 2003 ORDER :

This Writ Petition is filed for appointment on compassionate grounds. It has been contended by the petitioner that the father of the petitioner who was working with the respondents has expired on 16.7.1998, while discharging his duties. Thereafter, the petitioner has submitted application to consider his case for compassionate appointment. The respondents have directed the petitioner to appear for the selection vide letter dated 12.3.1999 and the petitioner had appeared before the selection committee for consideration of his case for appointment on compassionate grounds. However, the respondents have not passed any orders. Challenging the action of the respondents for not selecting him on compassionate grounds, the present Writ Petition is filed.

The learned Counsel for the petitioner submits that appropriate orders may be passed directing the respondents to consider the case of the petitioner on compassionate grounds.

The learned Standing Counsel for the respondents contends that appropriate orders would be passed in accordance with rules. 4.

This Court, having considered the rival contentions made by the parties, is of the view that the Writ Petition can be disposed of directing the petitioner to submit a fresh representation to the respondents seeking compassionate appointment within two weeks from the date of receipt of a copy of this order and the respondents shall consider his case afresh by duly taking into account letter dated 12.03.1999 and pass appropriate orders in four weeks thereafter. 5.

With this direction, Writ Petition is disposed of.
