THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.3500 OF 2017 ORDER:
This writ petition is filed, under Article 226 of the Constitution of India, for the following relief: "to issue a writ, order or direction more particularly one in nature of writ of Mandamus declaring the action of Respondents 2 to 4 in supplying commodities to Fair Price Shop.no.49, Gangamma Gudi, Basinikonda Gram Panchayath, Madanapally Mandal, Chittoor District by renewing petitioner's temporary authorization issued through 3rd Respondent's proceedings dt.02-04-2016 as illegal and arbitrary and consequently direct the Respondents 2 to 4 to supply commodities to Fair Price Shop.no.49, Gangamma Gudi, Basinikonda Gram Panchayath, Madanapally Mandal, Chittoor District for distributing same to card holders by renewing petitioner's temporary authorization issued through 3rd Respondent's proceedings dt.02-042016." 2.
When the matter is called, an order passed by the SubCollector, Madanapalli, vide Roc.A3/531/2016, dated 08.02.2017, appointing the petitioner DWACRA group temporarily as Fair Price Shop dealer of F.P. Shop No.49, for a period of three months is placed on record.

It is submitted by the learned counsel for the petitioner that though the petitioner herein has paid amount towards
AVSS,J W.P.No.3500 of 2017 stocks, the respondents are not supplying the commodities, despite the said order.

On the otherhand, it is submitted by the learned Government Pleader that a notification has already been issued, inviting applications for appointment of permanent Fair Price Shop dealer.

It is made clear that the respondents can go ahead with the appointment of permanent dealer, however, since the order of the Revenue Divisional Officer, dated 08.02.2017 is in existence, respondents are directed to supply the commodities to the petitioner herein for F.P. Shop No.49 at Gangammagudi of Basinikonda Village, Madanapally Mandal, Chittoor District, for distributing the same to the card holders till the permanent arrangement is made or till the expiry of the period covered by the above said order dated 08.02.2017, whichever is earlier.

With the above direction, this writ petition is disposed of. Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
