THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.6650 OF 2016 ORDER:
This petition is filed by the petitioner-accused under Section 482 Cr.P.C. seeking to quash the proceedings against him in C.C.No.1445 of 2014 on the file of the II Additional Judicial First Class Magistrate, Tanuku, West Godavari District.
Heard and perused the material available on record. The petitioner is alleged to have committed the offence punishable under Sections 138 and 142 of the Negotiable Instruments Act.
Learned Counsel for the petitioner submitted that the petitioner used to sign in English and he never signed in Telugu and the signature on the cheque is rank forgery.
The grounds raised by the learned Counsel for the petitioner are the points to be decided by the trial Court after fullfledged trial. Therefore, this Court is not inclined to interfere with the trial in the above case.
At this stage, the learned Counsel for the petitioner prayed for dispensing with the presence of the petitioner before the trial Court. In view of the above submission, the presence of the petitioner before the trial Court is dispensed with except on the dates when his presence is specifically required by the trial Court. The petitioner is directed to be represented through a Counsel before the trial Court on all hearing dates.
