O R D E R
Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue for the respondents.
Aggrieved by the action of the 4th respondent - SubRegistrar, in refusing to receive, register and release the documents presented by the petitioner in respect of land in Sy.No.388/5 admeasuring Ac.0.17 cts. situated in Settipalli Village of Tirupati Urban Mandal, Renigunta Sub Division of Chittoor District, based on the letter addressed by the 3rd respondent - Tahsildar, Tirupati Urban Mandal to the Sub Registrar, Renigunta vide ROC No.55/2015, the present writ petition has been filed.
The learned counsel for the petitioner submits that this court in similar facts and circumstances in W.P.No.22498/2016 dated 15.7.2016 disposed of the writ petition with a direction to register the document and that the same order may be passed in the present writ petition.
As per the submissions of learned Assistant Government Pleader for Revenue and the written instructions produced, the subject matter in the present writ petition and the subject matter in the writ petition relied on by the learned counsel for the
petitioner is one and the same and that the present writ petition may be disposed of in terms of the order dated 15.7.2016 in W.P.No.22498/2016.
The relevant portion of the order dated 15.7.2016 reads as under:
"In view of above facts and circumstances, the Sub Registrar, Renigunta shall not refuse to register the documents presented by the petitioner in respect of the lands owned by the petitioner through registered sale deeds in Settipalli Village as proceedings dated 03.03.2015 in Roc.No.A/55/2015 issued by the Tahasildar, Tirupati Urban to the Sub-Registrar, Renigunta are already set aside in W.P.No.13499 of 2016. The Sub-registrar, Renigunta shall register the documents presented by the petitioner if the same are in order as per provisions of Indian Stamps and Registration Act and the Rules made there under."
In view of the above facts and circumstances, the present writ petition is disposed of in terms of the above order dated 15.7.2016 in W.P.No.22498/2016.
No order as to costs.
Miscellaneous petitions pending if any, shall stand closed.
