SMT JUSTICE T.RAJANI CRIMINAL PETITON No.2038 OF 2018 ORDER:

This petition is filed, under Sections 437 and 439 of the Criminal Procedure Code, 1973, seeking to enlarge the petitioners, who are A3 and A4, on bail in Crime No.68 of 2017, on the file of Jami Police Station, Vizianagaram District, for the offences punishable under Sections 8(c) r/w Section 20(b)(ii) of NDPS Act. 2.

Heard the counsel for the petitioners and the Public Prosecutor appearing for the respondent.

The counsel for the petitioner submits that only 30 Kgs of Ganza was seized from four accused and hence, when it is divided among them, it would fall below the commercial quantity. The public prosecutor opposes the bail petition on the ground that the petitioners are involved in several offences, one being in Crime No.57 of 2017, on the file of Jami Police Station, Vizianagaram, in which these petitioners are found to be dealing with commercial quantity of Ganza.

Hence, considering the above, this criminal petition is dismissed. As a sequel, miscellaneous petitions pending consideration, if any, in this case shall stand closed. _____________ T.RAJANI, J 27.02.2018 SS
