This Criminal Petition is filed under Sections 480 and 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of bail to the petitioners, who are arrayed as accused Nos.2 and 3 in Crime No.3 of 2026 of EOW Cyb (Cyberabad) Police Station, Cyberabad Commissionerate, registered for the offences punishable under Sections 318(4), 338, 316(5), 329(3), 336(3), 340(2) and 61(2) of the BNS.

The case of the prosecution is that, on 21.01.2026, the defacto complainant lodged a report before the police stating that the complainant herein is a Corporator of Miyapur Division and according to the de-facto complainant, certain individuals/land mafia groups are illegally encroaching Government land, preparing fake and forged documents and fraudulently registering land and selling them to the public. These unlawful activities are causing major financial loss to innocent citizens and damaging public trust. In this connection, the concerned Sub-Registrar has already been suspended, which clearly establishes prima facie evidence of document fraud and illegal registration. Hence, he requested for necessary action. Basing on the said complainant, the police registered a case for the above said offences.

Heard Sri Vinod Kumar Deshpande, learned senior counsel representing Mrs. Devineni Radha Rani, learned counsel appearing on behalf of the petitioners as well as Sri Palle Nageshwar Rao, learned Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioners submitted that the petitioners herein purchased the alleged land in the year 1967 through a registered document and the same was challenged in
the Civil Court and in the subject property already there are civil disputes between the parties and this Court had gave Judgments in favour of the petitioners herein and the same was challenged before the Hon'ble Supreme Court vide SLP (CIVIL) Diary No.32368 of 2025 and the Hon'ble Supreme Court had passed the status quo order and inspite of the same, the de-facto complainant has lodged the report before the police only to harass the petitioners herein and the alleged registration was done on Sunday and on Sundays also registration can be done as per Rue 9 of the Registration Act and they are in jail since 04.02.2026 and the material part of the investigation was already completed. Therefore, he prayed the Court to grant bail to the petitioners by allowing this criminal petition. 5.
On the other hand, learned Public Prosecutor has filed counter and vehemently opposed the bail stating that the petitioners herein prudently fabricated the document to grab the Government land and the corporator being the responsible citizen having locus standi lodged a report before the police and the documents clearly shows that they are the fabricated documents to grab the Government land, as such, they are not entitled for the bail and prayed the Court to dismiss the Criminal Petition.

In the light of the submissions made by both the learned counsel and on a perusal of the material available on record, it is evident that the petitioners herein are in jail since 04.02.2026 and as seen from the record, the material witnesses were already examined by the prosecution and that apart, the alleged subject land was challenged before the Hon'ble Supreme Court vide SLP (CIVIL) Diary No.32368 of 2025 and the land which is covered in SLP and the subject land are one and the same and the Hon'ble Supreme Court had passed the status quo order and the same is pending. Considering the facts and circumstances of the case and also the pendency of the SLP, this Court deems it fit to grant bail to the petitioners/accused Nos.2 and 3, subject to the following conditions:
i.
The petitioners shall execute a personal bond for a sum of Rs.25,000/- each (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned Principal Junior Civil Judge-Cum-Judicial Magistrate of the First Class, Ranga Reddy at L.B. Nagar.
ii.
The petitioners shall appear before the concerned SHO at 11:00 a.m., on every
Monday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
iii.
The petitioners shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, this Criminal Petition is allowed.
Miscellaneous applications, if any pending, shall stand closed.
