HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Criminal Revision Case No.487 of 2018 ORDER:
Heard learned counsel for petitioner and this Crl.R.C. is disposed of at the admission stage, since this Court finds no necessity to order notice to respondents.
2) This Criminal Revision Case is filed by the petitioner aggrieved by the order dated 01.02.2018 in Crl.M.P.No.6 of 2018 in M.C.No.244 of 2014 passed by Judge, Family Court, R.R.District, L.B.Nagar, Hyderabad whereby and whereunder the learned Judge dismissed the petition on the observation that petitioner can as well obtain salary certificate of the 2nd respondent from the HDFC Bank. Thus, the Court refused to summon HDFC Bank Manager, Begumpet Branch to depose with regard to monthly salary of 2nd respondent. Hence, Crl.R.C.
3) The apprehension of learned counsel for petitioner is that the bank may not issue the salary certificate of the 2nd respondent though an application is made on the ground that information sought for is a private one. He however admits, so far no effort has been made by the petitioner.
4) In that view of the matter, this Crl.R.C. is disposed of with a direction to the petitioner to apply for salary certificate of the 2nd respondent and if for any valid and legal reasons the bank refuses to issue salary certificate under RTI Act, then petitioner can approach
the trial Court and seek for summoning the responsible bank officials to depose about the employment and salary particulars of the 2nd respondent herein in which case, the trial Court shall allow the said application.
As a sequel, miscellaneous applications pending, if any, shall stand closed.
