HONOURABLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No. 29004 of 2015 ORAL ORDER:

Petitioner claims to be absolute owner of flat No. 406 on fourth floor with undivided share of land admeasuring 40.72 square yards in Leelam Residency, Barkatpura, Hyderabad. Petitioner states that believing the version of builder and owner of the property that all required building permission were taken, he purchased the flat. However, having come to know that there were deviations to the building permission granted and taking advantage of scheme formulated by the State Government for regularization of unauthorized constructions notified vide G O Ms No. 419 dated 20.7.1998, petitioner submitted application for regularization of deviations and assigned file No. 4945/BRS/HO/98 dated 29.8.1998, but so far no orders are passed, hence, this writ petition.

2. When the matter is taken up, learned standing counsel for respondent municipal corporation submits that competent authority shall consider the application submitted by the petitioner for regularization and shall take an appropriate decision in the matter.

3. Learned counsel for petitioner as well as learned standing counsel for respondent corporation requested to dispose of the writ petition at the admission stage with a direction to the competent authority to take a decision on the building regularization application submitted by the petitioner.

4. Having regard to the same, writ petition is disposed of directing the third respondent to consider and pass appropriate orders on the building regularization application submitted by petitioner expeditiously, preferably within a period of six weeks from the date of receipt of copy of this order. No costs. Consequently, miscellaneous petitions, if any pending, are closed.
