THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.5697 of 2018 ORDER:

This Writ Petition is filed challenging the action of the fifth respondent in interfering with the possession of the property of the petitioner situated in Survey No.227 in an extent of Acs.4.00 of Bomraspet Village, Narayanpet Division, Mahabubnagar District pursuant to the proceedings issued under Section 7 of the Andhra Pradesh Land Encroachment Act, 1905, for which objections were filed by the petitioner on 15.02.2018 by post.

Learned Counsel for the petitioner submits that in spite of filing objections to the notice dated 07.02.2018, the fifth respondent is trying to disturb the possession of the petitioner. Since the petitioner filed objections within seven days after receipt of the notice dated 07.02.2018, the fifth respondent cannot interfere with the possession of the petitioner without passing final order. If no final order is passed by the fifth respondent, the fifth respondent is directed to pass the final order in accordance with law and serve a copy of the same to the petitioner and till such time, the property of the petitioner covered by the notice under Section 7 of the Andhra Pradesh Land Encroachment Act shall not be interfered with.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 21.02.2018 vs
