THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.2531OF 2023 ORDER:

This Criminal Petitlon is filed under Section 482 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.') by the petitionerAccused No.6 to quash the proceedings against him in C.C.No.239 of 2012 pending on the file of X Metropolitan Magistrate, Malakjgiri, Cyberabad, Jangaon, filed for the offences punishable under Sections 468,471and 420 of Indian Penal Code. 2.

Heard. Perused the record.

Since the crime is of the year 2011 and the case is of the year 2012, without going into the facts of the case, this Court deems it appropriate to direct the X Metropolitan Magistrate, Malakjgiri, Cyberabad, Jangaon, to dispose off the said calendar case as ( expeditiously as possible, within a period of six (06) months, in accordance with law, from the date of receipt of a copy of this order. 4.

Further, considering that the petitioner - accused No.6 is a woman aged about 55 years, this Court.is inclined to dispense with the attendance of the petitioner - Accused No.6 in C.C.No.239 of

2012 pending on the file of X Metropolitan Magistrate, Malakjgiri, Cyberabad, Jangaon, when'represented by her counsel on record. The attendance of the petitioner is dispensed with subject to filing an affidavit by the petitioner stating that in her absence the proceedings conducted by her counsel will not be disputed by her in any manner and shall not dispute her identity also. However, the petitioner shall appear before the learned Magistrate as and when her presence is required. In the event of the failure of the petitioner to appear when the Court directs, this order dispensing her attendance shall stand cancelled.
