HON'BLE DR. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.9084 of 2017 ORDER:

Heard learned counsel for the petitioner, learned Public Prosecutor and perused the record.

This Criminal Petition is filed by the petitioner-accused No.2 to quash the proceedings in Crime No.163 of 2015 on the file of Pentapadu Police Station registered for the offences punishable under Sections-498-A IPC and Sections-3 and 4 of the Dowry Prohibition Act, 1961.

Learned counsel for the petitioner and the learned Public Prosecutor would submit that the case is under investigation and it is squarely covered by the judgment, dated 27.7.2017, of the Hon'ble Apex Court in Crl.A.No.1265 of 2017 {SLP (Crl.).No.2013 of 2017} (Rajesh Sharma and Others Vs. State of U.P. and another).

In view of the mandate in the above case, it is appropriate to direct the Police concerned to abide by the directions given in Rajesh Sharma's case (supra) and refer the matter to the Committee to be constituted to consider any reconciliation and settlement and if it is not settled, then to proceed with the investigation of the case.

The Criminal Petition is, accordingly, allowed.

As a sequel, the Miscellaneous Petitions, if any, shall stand disposed of.
