THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.34897 of 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed to declare the action of the 6th respondent in calling the petitioners to I Town Police Station, Narasaraopet, Guntur District and threatening them to make settlement with respondents 3 to 5, as arbitrary and illegal. 2.

It is the case of the petitioners that the entire transaction between them and the person, who already purchased the property, is not in dispute. Without there being any crime registered against the petitioners, the 6th respondent herein due to intervention of respondents 3 to 5 calling the petitioners, abusing them in filthy language, detaining them in the police station and to settle the issue between them and respondents 3 to 5. 3.

This Court heard and perused the material available on record.

Admittedly, there is no case registered against the petitioners. The grievance of the petitioners that without there being any crime registered against them, the act of the 6th respondent is highly illegal.

Considering the facts and circumstances of the case, 6th respondent shall not interfere with the affairs in between of the petitioners and respondents 3 to 5 herein, more particularly the civil disputes pending between the petitioners and respondent 3 to

5. It is made clear that if there is any case registered against the

petitioners on the basis of any complaint, it is left open to the respondents to proceed with the investigation as per the procedure envisaged in Cr.P.C.
