THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.6551 OF 2016 ORDER:
The petitioner/A-1 preferred the present Criminal Petition by invoking the provision under Section 482 of the Code of Criminal Procedure (in short 'Cr.P.C.') seeking to quash the proceedings in C.C.No.395 of 2014, on the file of the XIII Additional Chief Metropolitan Magistrate, City Criminal Court, at Hyderabad. Heard and perused the material available on record. While pendency of the petition, the de facto complainant/ respondent No.2 herein filed an affidavit informing that she is not interested in proceeding against the petitioner herein in view of the award passed by the Lok Adalat. The Court perused the affidavit and examined the de facto complainant, who appeared before this Court. She reiterates the contents of the affidavit and informed that she is not interested in proceeding with the accused.
Considering the said factual circumstances, the Criminal Petition is allowed and the proceedings in C.C.No.395 of 2014, on the file of the XIII Additional Chief Metropolitan Magistrate, City Criminal Court, at Hyderabad are hereby quashed.
Consequently, the Miscellaneous Petitions pending in this petition, if any, shall stand closed.
