THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.5607 of 2018 ORDER:
This Writ Petition is filed challenging the order passed by the second respondent dated 03.01.2009 setting aside the order passed by the third respondent dated 07.12.1993.
The petitioner states that he is not a party to the proceedings. But, however, now the third respondent passed an order on 24.05.2017 ordering mutation of the name of the petitioner in respect of the land admeasuring Acs.4.33 guntas in Survey No.89 situated at Maheshwaram Village and Mandal, Ranga Reddy District. Learned Counsel for the petitioner submits that in spite of the mutation order of the third respondent, based on the earlier order, the unofficial respondents are trying to interfere with the possession of the petitioner.
When there is an order of mutation in favour of the petitioner and when there is no allegation of interference by the official respondents, the only remedy available to the petitioner is to go to Civil Court for appropriate relief.
This Writ Petition is not maintainable, and the same is, accordingly, dismissed. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
