THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.32448 of 2017 ORDER:

The present Writ Petition, under Article 226 of the Constitution of India, came to be filed questioning the order dated 22.08.2017 passed by the second respondent in Rc.E.No.30/2017. Heard the learned counsel for the petitioner, the learned Assistant Government Pleader for Civil Supplies and the learned Assistant Government Pleader for Revenue. With their consent, the Writ Petition is disposed of at the stage of admission itself. As seen from the record, on 19.12.2016 the third respondent issued suspension orders in respect of dealership of the petitioner, on the ground that on 15.12.2016, the Mandal Revenue Officer inspected the fair price shop of the petitioner and found variations in stok. Challenging the same, petitioner filed an appeal along with stay application before the second respondent-Joint Collector. Vide impugned order, the second respondent directed the third respondent to dispose off the case within four weeks from the date of receipt of the impugned order. Aggrieved by the same, the present writ petition came to be filed.

It is to be noted that the second respondent while confirming the order passed by the third respondent, has clearly observed that the order passed by the third respondent is only interim in nature and final orders are yet to be passed at divisional level. Thus, the second respondent directed the third respondent to dispose off the case within four weeks. Hence, I do not see any illegality in the impugned order.

However, having regard to the facts and circumstances of the case, the third respondent-Revenue Divisional Officer shall dispose of the proceedings in Rc.B.922/2016 as early as possible preferably within a period of four weeks from today, in accordance with law.

Accordingly, the Writ Petition is disposed of. Consequently, miscellaneous petitions pending in this petition, if any, shall stand closed.
