HONOURABLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON No.6774 of 2019 ORDER:
The prayer of the petitioners in this case reads as under: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue writ or direction more particularly one in the nature of writ of Mandamus declaring the action of the 3rd respondent in not issuing title deeds to the petitioners in respect of the lands in Sy.No.108 to an extent of Ac.6.07 gts, Sy.No.109 to an extent of Ac.7.07 gts, Sty.No.110 to an extent of Ac.3.18 gts and Sy.No.111 to an extent of Ac.3.33 gts each situated at Thattiannaram Village Abdullapurmet Mandal Ranga Reddy District by disposing of the application of the petitioners dt 12.02.
2019 is illegal arbitrary against the principles of natural justice and consequently direct the respondent No 3 to issue title deeds in favour of the petitioners in respect of lands in Sy.No.108 to an extent of Ac.6.07 gts, Sy.No.109 to an extent of Ac.7.07 gts, Sty.No.110 to an extent of Ac.3.18 gts and Sy.No.111 to an extent of Ac.3.33 gts each situated at Thattiannaram Village Abdullapurmet Mandal Ranga Reddy District and pass and pass such other relief or reliefs as this Honble Court deems fit and proper in the circumstances of the case."
Perusal of the record reflects that the Tahsildar concerned already recognized the rights of the petitioners in the land in question by issuing them certificates in Form 1B. The grievance of the petitioners is that the Tahsildar is not issuing them the new pattadar pass books as per the Government's Policy. Their representation in this regard made on 12.02.2019 was received by the Tahsildar concerned.
Having received such an application, it is not open to the Tahsildar concerned to remain somnolent.
The Writ Petition is accordingly disposed of directing the Tahsildar, Abdullapurmet Mandal, Ranga Reddy District, to take appropriate action upon the petitioners' representation dated 12.02.2019 expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order, be it from whatever source.
Miscellaneous Petitions pending in this Writ Petition shall stand closed in the light of this final order. No order as to costs. ____________________ JUSTI CE SANJAY KUMAR 1st April, 2019.
