SMT JUSTICE T.RAJANI CRIMINAL PETITON No.2055 OF 2018 ORDER:

This petition is filed seeking for grant of anticipatory bail to the petitioner, who is A1, in Crime No.122 of 2017 on the file of Koilakuntla Police Station, Kurnool District. The offences alleged are under Sections 307, 324, 498-A r/w 34 IPC and Sections 3 and 4 of Dowry Prohibition Act.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

The allegations are that the petitioners and his parents harassed the defacto complainant for dowry and that they also tried to kill her, by hanging her with chunni and by pressing her neck. She also states that at that time, nearby people came to release her from the clutches of her husband and his parents. The counsel for the petitioner contends that the allegations made against the petitioners are absolutely false and that in fact, accused No.3, who is the mother-in-law underwent knee replacement surgery and was in hospital during that time. But the public prosecutor reads the statement of one of the independent witnesses L.W.4 - Kamini Bhaskar Reddy, wherein it is clearly stated, that on hearing some noise from the house of the father of the defacto complainant, he went there and found A1 and others, beating the defacto complainant.

Hence, in view of the above, this Court opines that it is not a fit case for grant of anticipatory bail.

Accordingly, the Criminal Petition is dismissed. However, the petitioner is at liberty to file a petition seeking for regular bail by surrendering himself before the court below having the jurisdiction. The court below shall dispose of the bail application on merits, if any filed, expeditiously, preferably on the same day, subject to the pressure of other work.

As a sequel, miscellaneous petitions pending consideration, if any, in this case shall stand closed.
