THE HON'BLE SRI JUSTICE K.C. BHANU AND THE HON'BLE MRS JUSTICE ANIS WRIT PETITION No.13601 OF 2015 ORDER: (per Hon'ble Sri Justice K.C.Bhanu) This Writ Petition, under Article 226 of the Constitution of India, is filed to call for the records relating to the order, dated 14.11.2014, in Original Application No.6496 of 2014 passed by the Andhra Pradesh Administrative Tribunal, Hyderabad (for short, 'the Tribunal') and quash the same and consequently, hold that the petitioner is entitled to continue as Principal at Government Junior College (Girls), Narsipatnam, Visakhapatnam District, with all consequential benefits.

2. The petitioner herein/applicant filed the aforesaid Original Application questioning the transfer order vide Rc.No.Ser.I-1/1/2012, dated 31.10.2014, issued by respondent No.2, whereby he was transferred and posted as Principal, Government Junior College, Bhimini, Srikakulam District. He also sought for an interim direction to suspend the said order and continue him in the same place until further orders. The Tribunal, upon considering the material on record, refused to grant the interim order. For not granting any interim order, the petitioner filed the present Writ Petition.

3. Learned counsel for the petitioner contended that as the order of transfer is punitive in nature, it has to be set aside.

4. The contention raised by the learned counsel for petitioner has to be decided by the Tribunal after completion of pleadings.

5. Therefore, the Writ Petition is disposed of directing the official respondents to file counter in the Original Application within a

period of four (4) weeks from the date of receipt of a copy of this order and thereafter, we request the Tribunal to dispose of the Original Application within a period of four (4) weeks thereafter after giving due opportunity to both the parties. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
