2017-07-25S.V.Bhatt2 pages

HON'BLE SRI JUSTICE S.V. BHATT W.P. No.45724 OF 2016 ORDER:

Heard the counsel for petitioners and the Assistant Government Pleader (Assignment) for respondents. The petitioners pray for the following relief: "...Mandamus declaring the action of the respondents in highhandedly trying to dispossess the petitioners from the lands admeasuring Ac.4.85 cents in Survey No.2204 of Pedda Orampadu Village, Obulavaripalli Mandal, YSR Kadapa District as illegal, arbitrary, violative of Articles 14, 21 and 300-A of the Constitution of India and consequently direct the respondents not to dispossess the petitioners from the above land..."

This Court on 27.01.2017 passed the following interim order: "The respondents shall not dispossess the petitioners from the subject land without following due process of law until further orders."

Respondents have neither filed counter affidavit nor a petition to vacate the interim order dated 27.01.2017, much less instructions.

As the prayer is substantially against the threatened action of dispossession, having regard to the material available on record and without expressing any view on merits, the writ petition is disposed of by making the interim order dated 27.01.2017 as final order in the writ petition. The respondents are directed not to disturb the petitioners' possession except in accordance with law. No order as to costs.

Miscellaneous petitions pending, if any, shall stand closed. ___________ S.V.BHATT, J Date:25.07.2017 Stp
