THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 5599 of 2018 O R D E R :

The challenge in this Writ Petition is as to the proceedings, dated 10.02.2018 of the 1st respondent State of Telangana. Heard learned counsel for the petitioner as well as Ms. K. Kiranmayee, learned counsel for the 5th respondent. The order under challenge reads as under:

" The attention of the District Collector (PW), RR / District Panchayat Officer, Ranga Reddy District are invited to the references cited and they are informed that Government have granted stay on the orders of the District Collector, RR District issued vide Proc. No. 5347/2015-A2 Pts., dt. 03.10.2017.

The District Collector (PW), RR / District Panchayat Officer, Ranga Reddy shall take necessary action accordingly and further he is requested to furnish a detailed report along with Physical Verification Report of works executed by the Sarpanch Ravirala G.P. Maheshwaram Mandal, R.R. District, to Government immediately, for taking further necessary action in the matter." A perusal of the above-quoted paragraphs does not indicate that there is any cause of action for the petitioner to challenge the order dated 10.02.2018, as, in the first paragraph, the factum of there being a stay granted in favour of the 5th respondent on 03.10.2018 has been recorded and in the second paragraph, a direction was issued to the District Collector / District Panchayat Officer to take action accordingly.

In those circumstances, there being no cause of action arising for the petitioner to challenge the proceedings, dated 10.02.2018, the Writ Petition is closed. It is, however, open for the petitioner to seek modification of the said proceedings dated 10.02.2018. No costs.

Consequently, the miscellaneous Applications, if any shall also sand closed.
