THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.14960 of 2013 ORDER:

This petition is filed under Section 482 Cr.P.C. by the petitioners/A.1 to A.5 seeking to quash the proceedings in Crime No.213 of 2013 of Women Police Station, Saroornagar, Cyberabad, wherein they were charged for the offences under Sections 498-A and 307 IPC and Sections 3 and 4 of Dowry Prohibition Act.

2. When the matter came up for hearing, learned Public Prosecutor produced a copy of charge sheet and submitted that in this case police have laid charge sheet on 22.04.2014 against A.1 and A.5, by omitting A.2 to A.4, which was taken cognizance by learned XIV Metropolitan Magistrate, L.B.Nagar and registered as C.C.No.388 of 2014 for the offences under Sections 498-A and 326 IPC and Sections 3 and 4 of Dowry Prohibition Act and in view of the same, the instant application, which is filed seeking quashing of F.I.R No.213 of 2013, has become infructuous and hence, may be dismissed.

3. There is no representation for petitioners. It is seen that there is no stay pending in this matter. In view of above submission and upon perusal of copy of the charge sheet, the Criminal Petition is dismissed as infructuous with a liberty to the petitioners/A.1 and A.5 to challenge the charge sheet by initiating appropriate proceedings. Miscellaneous petitions, if any, pending in this Criminal Petition shall stand closed.
