HON'BLE SRI JUSTICE RAJA ELANGO Writ Petition No.36470 of 2016 O R D E R :

The Writ Petition is filed under Article 226 of the Constitution of India seeking to issue a writ or order, more particularly one in the nature of writ of Mandamus declaring the inaction of the official respondents in not providing aid/protection to the decree and judgment passed by the Hon'ble VIII Addl. Senior Civil Judge, dated 21-102013 in O.S.No.1286 of 2009 in respect of property plot No.39, admeasuring 250 sq. yards in block No.1, southern part of the land is in Sy.No.78, Sri Sai Hills, Venkatramana Colony, Gokul Plots, Hafeezpet Village, Serilingampally Mandal, R.R.District, as illegal and arbitrary and consequently direct the official respondents to provide police aid/protection to the petitioner in implementing the court orders passed in O.S.No.1286 of 2009 on the file of VIII Additional Senior Civil Judge, R.R.District.

The learned counsel for the petitioner submits that unofficial respondents do not have any right or possession over the property at any point of time and as they are having access with the antisocial elements, they are constantly threatening to dispossess the petitioner. Having regard to the facts and circumstances of the case and in view of the submission of the learned counsel for the petitioner, this Court directs the Police concerned to proceed with the investigation

and if the petitioner informs the official respondents apprehending danger in the hands of the unofficial respondents, the official respondents are directed to take appropriate steps to protect the rights of the petitioner herein.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Consequently, Miscellaneous Petitions pending, if any, in the Writ Petition shall stand closed.
