Heard Sri C.Raja Sekhar Reddy, learned counsel for the petitioner, learned Government Pleader for Panchayat Raj appearing for respondents 1 to 4 and Sri G.Narender Reddy, learned standing counsel for the 5th respondent. 2.
Petitioner was appointed as Field Assistant on contract basis in the year 2006 and continued to work in the said capacity till 2014-15. Thereafter, the petitioner is not continued. 3.
It appears, Karvanga Gram Panchayat does not have the required mandates to employ a person as a Field Assistant. However, the petitioner is willing to work as Senior Mate. Considering the request of the petitioner and the necessity to have a Field Assistant, the District Rural Development Officer, District Water Management Agency, Nagarkurnool District, the 3rd respondent, addressed a letter dated 20.12.2016 to the Commissioner, Rural Development Agency, the 2nd respondent, requesting to consider the appointment of the petitioner as Senior Mate. Alleging inaction on the said proposal submitted by the 3rd respondent and not providing employment, the petitioner filed this Writ Petition.

In support of the contention of the petitioner that he is entitled to be appointed at least as a Senior Mate, reliance is placed on the circular issued by the Government on 18.09.2015. Paragraph No.3 of the circular provides the list of guidelines where
the performance of the Gram Panchayat is below 1000 person days and Clause (a) of the circular envisages appointment of Senior Mate to such Gram Panchayat.

Learned counsel for the petitioner therefore submits that in accordance with the policy decision of the Government as notified on 18.09.2015, the proposal submitted by the 3rd respondent on 20.12.2016 ought to have been considered and appropriate decision ought to have been taken.

It is not in dispute that the proposals are yet to be acted upon by the 2nd respondent.

Having regard to the same, without expressing any opinion on the merits of the case, the Writ Petition is disposed of directing the 2nd respondent to examine the proposal submitted by the 3rd respondent on 20.12.2016 to accommodate the petitioner as Senior Mate/Field Assistant to Karvanga Gram Panchayat, Telkapalli Mandal, Nagarkurnool District. A decision to this effect shall be taken duly taking note of the circular dated 18.09.2015, as expeditiously as possible, preferably within a period of six weeks from the date of receipt of a copy of this order and communicate the same to the petitioner. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
