Heard the learned counsel for the petitioner and Sri M.Venugopal Rao, learned Standing Counsel, appearing for the 2nd respondent-State Board of Technical Education and Training. 2.

Petitioner is appearing in examinations being conducted by the Secondary School Certificate (SSC) Board and the last examination is scheduled to be held on 03-04-2019. Meanwhile, the 2nd respondent has issued notification, dated 14-03-2019, for conducting Polytechnic Common Entrance Test-2019 fixing the date of entrance test on 16-04-2019. Petitioner challenges this schedule fixed by the 2nd respondent by contending that there is very limited time for the students to prepare for the Polytechnic Common Entrance Test as the last date of examination of SSC is scheduled on 03-04-2019 and having regard to the same, 2nd respondent ought to have postponed holding the Common Entrance Test on 16-04-2019 to any other date. Petitioner also claims to have made a representation on this aspect before the 2nd respondent and this Writ Petition is filed alleging inaction on the representation made by the petitioner.

Learned Standing Counsel for the 2nd respondent, on instructions, informs the Court that the examination is scheduled to

PNR,J be conducted in 390 centers spread over the State; already arrangements are made in identifying the centers and all other aspects to conduct Common Entrance Test and it is not possible to postpone the test at this last minute. Therefore, he submits that the 2nd respondent is not inclined to postpone the examination. 4.

Admittedly, during the months of April and May, entrance tests are conducted to various courses such as polytechnic, engineering, agriculture, animal husbandry, medicine and law etc., and such tests are conducted by various Institutions/ Universities/States, and therefore it would be difficult to secure a slot to conduct examinations unless arrangements are made in advance. Similarly, the 2nd respondent must have made all arrangements in advance to hold the test on 16-04-2019.

It is not in dispute that the schedule was announced by the 2nd respondent noting the SSC examinations were to be concluded by 31-03-2019. After the notification of entrance test date, due to some unavoidable reasons i.e. holding elections to the Members of Legislative Council on 22-03-2019, one of the SSC examinations scheduled on 22-03-2019 was postponed to 03-04-2019. This could not have been anticipated by the 2nd respondent. Be that as it may, the 2nd respondent cannot be compelled to postpone the Common Entrance Test from 16-04-2019 on the ground that preparation time is very less. Further the preparation time available to all the students participating in the

PNR,J Common Entrance Test is the same as all of them have to write SSC examinations. Therefore, it is not the case of having undue advantage to few sections of students leaving others. 6.

In view of the same, this Court is not inclined to entertain the Writ Petition and grant relief as prayed. Accordingly, the Writ Petition is dismissed.

As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
