HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

Aggrieved by the decision of Agency Divisional Officer, Kothagudem in LTR Case No.3/2011/SINGARENI, petitioner preferred appeal before the Additional Agent to the Government in C.M.A.No.48 of 2011. Said C.M.A., was dismissed on 29.01.2019. Aggrieved thereby, petitioner preferred Revision before the Government. Along with the Revision, petitioner also filed application to grant stay pending revision. Alleging that no decision is made on the application to grant stay, and there is a threat of dispossession unless relief granted to him, this Writ Petition is filed.

According to the learned counsel for petitioner, in I.A.No.27 of 2011 in C.M.A.No.48 of 2011, 2nd respondent granted stay of the order of lower authority, pending disposal of the appeal. 3.

He would submit that since petitioner has protection of stay pending appeal, the revisional authority ought to have considered the interlocutory application for grant of protection, pending disposal of the revision, and cannot keep the interlocutory application without a decision being made.

If that is so, without expression any opinion on merits, Writ Petition is disposed of, directing the 1st respondent to consider the interlocutory application for grant of protection pending revision, within a period of four weeks from the date of receipt of copy of this order. Pending disposal of the said application, stay granted by the appellate authority in I.A.No.27 of 2011 in C.M.A.No.48 of 2011

shall be continued. Pending miscellaneous petitions shall stand closed.
