HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.6263 of 2006 ORDER:

This writ petition is filed seeking a Writ of Mandamus declaring the action of respondents in not considering the case of petitioners and not promoting them in the category of Assistant Divisional Engineer in the respondent Corporation as illegal and arbitrary and consequently sought a direction to the respondents to promote them in the category of Assistant Divisional Engineer. On 29.03.2006, this Court granted interim order directing the respondents to keep eight posts vacant in the category of Assistant Divisional Engineer until further orders.

Learned counsel for petitioners contended that the petitioners are fully eligible and qualified to be promoted to the post of Assistant Divisional Engineer.

Learned Standing Counsel appearing for respondents contended that the case of the petitioners would be considered in accordance with Rules, if they are eligible and qualified for such promotion.

In view of the above said submission, the writ petition is disposed of directing the respondents to consider the case of petitioners for promotion to the post of Assistant Divisional Engineer, if they are otherwise eligible and qualified, in accordance with Rules. No order as to costs.
