THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 32915 of 2014 ORDER: (Per the Hon'ble the Chief Justice Sri Kalyan Jyoti Sengupta) This writ petition has been filed challenging the proceedings initiated before the Hon'ble Lokayukta vide complaint No.349/2013/B1 and the report of the 3rd respondent dated 06.09.2014. According to us, it is a premature stage to challenge the same, as it appears the matter is still pending for consideration before the Hon'ble Lokayukta. In the counter affidavit the petitioner has taken a preliminary point to the effect that even on the facts and circumstances of the complaint the above proceedings should not have been initiated under the relevant provision of law. We think that this preliminary issue should be decided first, as it goes to the very root of the matter. Therefore, we request the Hon'ble Lokayukta to consider the preliminary issue raised in the counter affidavit on the next date of hearing and take a final decision in accordance with law. All points are kept open.

The writ petition is accordingly disposed of. Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
