THE HON'BLE THE CHIEF JUSTICE UJJAL BHUYAN AND THE HON'BLE SRI JUSTICE N.V.SHRAVAN KUMAR Writ Petition No.5596 of 2018 in C.S.No.13 of 1958 ORDER: (Per the Hon'ble the Chief Justice Ujjal Bhuyan) None appears for the petitioners on call. However, Mr.Parsa Ananth Nageswar Rao, learned counsel attached to the office of the learned Additional Advocate General has appeared for respondent Nos.1 & 2; Mr.Gadi Praveen Kumar, learned Deputy Solicitor General of India for respondent Nos.3 to 7; and Mr.K.R.Koteswara Rao, learned standing counsel for respondent No.8.
2. This writ petition has been filed assailing the action of respondent Nos.1 & 2 in acquiring the land admeasuring Ac.55 - 00 gts in Sy.No.Old No.37 and New No.170 of Thokatta Village by entering into negotiations with respondent Nos.3 to 8 offering other lands in view of compensation ignoring the rights of the petitioners.
3. We are afraid, we cannot examine legality and correctness of land acquisition proceedings under Article 226 of the Constitution of India. That apart, the land acquired pertains to suit schedule property in C.S.No.13 of 1958 where new Secretariat building of the State of Telangana was proposed to be constructed.
4. We do not find any good reason to entertain the writ petition.
5. However, as there is no representation on behalf of the petitioners, the writ petition is dismissed for nonprosecution. Miscellaneous petitions, pending, if any, shall stand closed.
