THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.2136 of 2018 ORDER:

This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed by the petitioner seeking to set aside the order dated 28.12.2017 passed in Crl.M.P. No.1001 of 2017 in Crl.R.P. No.33 of 2017 on the file of the Principal District and Sessions Judge, Adilabad. 2.

Heard the learned counsel for the petitioner, learned Assistant Public Prosecutor representing the 1st respondent-State and perused the record.

The impugned application was filed before the Court of Session to stay the proceedings in C.C. No.19 of 2010 on the file of the Junior Civil Judge, Bhainsa. The Court of Session while dealing with the stay application wanted to call for the records of the Court below to determine the Criminal Revision Petition. After dealing with the subject matter elaborately, the Court of Session felt that there are no justifiable grounds to stay the proceedings in C.C. No.19 of 2010 and by assigning number of reasons, dismissed the stay application. The subject matter was adequately dealt with by the Court of Session. There is no infirmity in the impugned order. The petition is devoid of merits and it is liable to be dismissed.
