THE HON'BLE DR. JUSTICE D.NAGARJUN CRIMINAL PETITION No. 1794 of 2022 ORDER:
This Criminal Petition is filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") for enlarging the petitioner-accused No.1 on regular bail in Crime No.311 of 2021 of Chityal Police Station of Nalgonda District registered for the offence punishable under Section 20(b)(ii)(A) of Narcotic Drugs and Psychotropic Substances Act, 1985. 2.
The only ground on which the learned counsel for the petitioner is seeking release of the petitioner on bail is that even though the statutory remand period of 180 days has already been completed, the respondent-Police could not complete investigation and charge sheet is also not filed. 3.
On the other hand learned Assistant Public Prosecutor has submitted that there is no clue as to whether charge sheet is filed or not.

Considering the above facts and circumstances, this Criminal Petition is disposed of with a direction to the trial Court to consider the application of statutory bail as per the
procedure, in case, if the charge sheet is not filed even after completion of 180 days from the date of remand. As a sequel, pending miscellaneous applications, if any, shall stand closed.
