SMT JUSTICE T. RAJANI MACMA.No.112 of 2006 ORDER:

This appeal is preferred by the second respondent - insurance company before the Court below, assailing the order of the learned Judge, Family Court-cum-Chairman, Motor Accident Claims Tribunal, Secunderabad, in O.P.No.124 of 2003 dated 22.11.2005 on several grounds which include the income taken by the Court below @ Rs.4,000/- per month.

At the hearing, learned counsel for the appellant does not press the other grounds of appeal with regard to the quantum and he only let in the argument by saying that the income of the deceased was taken by the Court below @ Rs.4,000/- per month is on higher side. But the trend of the law as has travelled till now is that even for a coolie, the income of Rs.4,500/- has to be taken. Hence, in view of the above legal position, the order of the Court below does not call for any interference. In the result, the appeal is dismissed but in the circumstances, without costs.

Pending miscellaneous petitions, if any, shall stand dismissed.
