THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.13867 OF 2015 ORDER:
This Criminal Petition is filed by the petitioner-accused invoking the provision under Section 438 of Cr.P.C. seeking a direction to the respondent-police to release the petitioner on bail in the event of her arrest in connection with F.O.No.83 of 2015-16 on the file of Wild Life Nandyal Range, Nandyal, Kurnool District registered for the offences under Sections 20(1)(c)(ii)(iii) & (x) of A.P. Forest Act, Sections 27, 29 r/w 51 of Wild Life Act and Section 379 IPC.
Heard the learned counsel for the petitioner and learned Additional Public Prosecutor. Perused the material on record. It is alleged that the petitioner is involved in theft of produce of the forest. Police laid the charge sheet showing the petitioner as absconding. The Court below took cognizance of the offence in C.C.No.1162 of 2015 and issued NBWs against the petitioner. In the circumstances of the case, the petitioner is directed to surrender before the Court below and file an application seeking to recall the warrant. On filing such application, the Court below is directed to recall the Warrant issued against the petitioner on the same day on execution of a bond by the petitioner for a sum of Rs.10,000/- with one surety with an undertaking for her further appearance for trial before it.
The Criminal Petition is accordingly disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
