THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.4690 of 2017 ORDER:
Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies.
This Writ Petition under Article 226 of the Constitution of India is filed seeking the following relief:
".... to issue a writ or order more particularly one in the nature of writ of mandamus or an appropriate writ or order declaring the action of the 3rd respondent in not releasing the essential commodities to the petitioner for distribution to the cardholders pertaining to the Shop No.30 of Konaganivaripalem Village, S.N.Padu Mandal, Prakasam District, is illegal, arbitrary and contrary to the control orders and consequently direct the 3rd respondent to release the essential commodities to the petitioner and pass such other order or orders as this Hon'ble Court may deem fit and proper in the interest of justice."
When the matter is called, the learned Government Pleader submitted that the petitioner herein has not produced the residential proof and other requisites for issuance of authorization in his favour and if the petitioner submits that same, the same will be processed and further action will be taken. In view of the said submission, the Writ Petition is disposed of keeping it open to the petitioner to submit all the requisites pursuant to the appointment order dated 17.01.2017 within a period of one week from the date of receipt of a copy of this order. On such submission, appropriate further action shall be taken by the respondents, in accordance with law, within a period of two weeks therefrom.
Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No order as to costs.
