This application is filed alleging wilful disobedience of interim order dt.15.12.2015 in W.P. No.40659 of 2015.
In the aforementioned interim order, this Court has directed the respondents not to disconnect the drinking water pipeline of the petitioner's house, bearing No.7-102 of Pandikona Village, Pattikonda Mandal, Kurnool District. The petitioner averred that though the factum of passing of the interim order was informed to the respondents, they have deliberately removed the connection.
Separate counter affidavits have been filed by the respondents wherein they have denied the knowledge of passing of the interim order. Though the petitioner has asserted that the respondents were aware of the passing of the interim order, no tangible evidence is filed in support thereof. Therefore, it is not possible for this Court to render a finding on the seriously disputed question of fact about the factum of the knowledge of the order of this Court. The learned counsel for the petitioner raised a serious grievance regarding existence of private taps in the village and the discriminatory treatment meted out to his client due to local political reasons. In my opinion, these issues can be adjudicated in the writ petition which is still pending.
