THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.7246 of 2012 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.128 of 2012 on the file of the Subedari Police Station, Warangal, registered for the offence punishable under Section 3(1)(x) of S.Cs. & S.Ts. (PoA) Act, 1989. Heard the learned counsel on either side and perused the material available on record.

Since this Court granted stay, the investigation could not be proceeded further.

The learned Public Prosecutor submitted that necessarily the investigation to be conducted and the truth or otherwise of the complaint to be unearthed by the Investigation Agency.

Considering the facts and circumstances of the case, this Criminal Petition is disposed of with the following direction :

The Respondent-Police are at liberty to proceed with the investigation and file charge-sheet, if any, without arresting the petitioner.
