HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 17475 of 2015 ORDER:
Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.
The petitioner is a proprietary concern of M/s. Uppala Venkateswara Rao Wholesale and Retial Food Grain Dealer, Visakhapatnam District. The registration of the petitioner is valid up to 31.03.2016. While so, the third respondent visited the business premises of the petitioner along with his staff on 7.5.2015 and seized some stock on the ground of variation in stock and thereafter a case under Section 6-A of the Essential Commodities Act was registered against the petitioner. The petitioner submitted an application on 11.5.2015 before the second respondent for release of the stock and the said application was rejected by proceedings dated 10.06.2015. Challenging the same, the present Writ Petition is filed.
It is admitted by the learned Counsel for the petitioner that 6-A proceedings are pending against the petitioner as of today and that the second respondent is competent to dispose of the said proceedings. In view of the rejection of the application filed by the petitioner for release of the stock, it is just and proper to direct the second respondent to dispose of the 6-A proceedings. Accordingly the second respondent is directed to dispose of the 6-A proceedings pending against the petitioner within a period of 90 days from the date of receipt of a copy of this order by duly observing the principles of natural justice. The Writ Petition is accordingly disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
