HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.12288 OF 2017 O R D E R :

This writ petition is filed challenging the notice dated 28.03.2017 issued by the 3rd respondent wherein the petitioner was directed to submit documents, within three days, as to how she erected 'puncture shop' in Plot No.46, Survey No.1022, situated at Dyagadoddi Village, Dharur Mandal, Mahaboobnagar District. Aggrieved by the same, present writ petition is filed.

Learned counsel for the petitioner submits that the petitioner was granted house site by the revenue authorities vide proceedings No.C/1078/2014, dated 18.01.2014, as such, issuance of notice is bad.

On the other hand, learned Assistant Government Pleader for Revenue submits that it is only notice for production of documents.

In view of the above, it is open for the petitioner to submit documents along with explanation before the 3rd respondent, within four weeks and on production of documents and explanation made by the petitioner, the 3rd respondent is directed to consider the explanation of the petitioner and pass orders after giving opportunity of hearing to the petitioner. If petitioner fails to submit explanation

within aforesaid period, it is open to the respondents to take action, in accordance with law. Till then, the petitioner shall not be evicted.

Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. ____________________________ A.RAJASHEKER REDDY, J 07.04.2017 tk
