THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8598 OF 2011 ORDER:

This Criminal Petition is filed by A.1 by invoking the provision under Section 482 of Cr.P.C. seeking to quash the charge sheet in S.C.No.40 of 2011 on the file of VII Additional District Judge-cum-Special Court of SC & ST Cases (POA) Act, Warangal, Warangal District arising out of Crime No.54 of 2010 of Kakatiya University Campus Police Station, Warangal for the offences punishable under Sections 447, 506 r/w 34 IPC and Section 3(i)(iv) & (x) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

After arguing for some time, the learned counsel for the petitioner confined his argument to the extent of dispensing with the presence of the petitioner before the trial Court. In view of the nature of the offences alleged, the question of identity of the petitioner before the trial Court does not arise. In the circumstances, the presence of the petitioner before the trial Court is dispensed with except on the dates so specifically the trial Court insists for his appearance. The petitioner is directed to be represented by a counsel on all hearing dates. If the petitioner is so advised, he is at liberty to raise all the points now raised, before the trial Court by way of filing discharge petition.

The Criminal Petition is accordingly disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
