HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN Civil Revision Petition No.3394 of 2016 Order:

As against the rejection of an application for referring Ex.B-3 Gift Deed to a fingerprint expert for examination under Section 45 of the Indian Evidence Act, the 3rd defendant in the suit has come up with the above revision.

2. Heard Mr. Narasimha Rao Gudiseva, learned counsel for the petitioner.

3. The Gift Deed Ex.B-3 was marked as a document by the petitioner himself. The stand taken by the plaintiff is that it is a fabricated document. Since Ex.B-3 is registered deed, the onus is shifted to the plaintiff to prove that it is a fabricated document. Therefore, the trial Court was not only right but actually did a favour to the petitioner in dismissing the application. Hence, I find no reason to interfere with the said order.

4. Therefore, the revision is dismissed. The miscellaneous petitions, if any, pending in this revision shall stand closed. No costs.
