HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.19506 OF 2016 ORDER:

It is the case of the petitioner that he has purchased agricultural land in R.S.No.6 in an extent of Ac.3.32 cents, situated in Akunuru Village, Vuyyuru Mandal, Krishna District, by way of auction conducted by the Junior Civil Judge, Vuyyuru in E.P.No.49 of 2013 in O.S.No.265 of 2005 and in pursuant to the same, possession of the said land was handed over on 26.03.2015. Though the petitioner made representation dated 25.05.2016 to the 4th respondent-Tahsildar to issue pattedar passbooks and title deed in respect of the subject land, no orders are passed on the same. Aggrieved by the same, present writ petition is filed.

Heard learned counsel for the petitioner, who submits that in pursuant to notice issued by the 4th respondent-Tahsildar in the month of November, 2015, petitioner submitted necessary documents before him. In spite of the same, no orders are passed till date.

Learned Assistant Government Pleader for Revenue submits that since civil suits are pending between the parties, action could not be taken on the application of the petitioner.

It is to be seen that in the civil suit filed by the judgment debtor in O.S.No.62 of 2015 only status quo was granted on 30.07.2015. As long as the sale certificate issued by the Junior Civil Judge, Vuyyuru in favour of the petitioner is valid and subsisting, the respondent authorities cannot refuse to grant pattedar passbooks and title deeds.

In view of the same, the 4th respondent-Tahsildar, Vuyyuru Mandal, Krishna District is directed to consider and dispose of the representation of the petitioner for granting pattedar passbooks and title deed dated 25.05.2016, after issuing notice to the affected parties, within a period of four

(4) weeks from the date of receipt of a copy of this order. However, issuance of pattedar pass books and title deed, will be subject to result of O.S.No.62 of 2015 before the Court below.

With the above direction, this writ petition is disposed of. There shall be no order as to costs.
