THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2586 of 2016 ORDER:

This Criminal Petition is filed by the petitioner-accused under Section 482 Cr.P.C., to quash the proceedings in Crime No.608 of 2015 on the file of S.H.O., Karimnagar Rural Police Station, Karimnagar for the offences under Sections 420, 323 and 506 IPC Heard.

On perusal of the entire material available on record, prima facie there are some allegations as against the petitioner and truth or otherwise of the said allegations can be ascertained by the investigating agency during the course of investigation and this Court is not inclined to quash the proceedings in the said crime at this stage. However, the complainant filed a private complaint before the Judicial Magistrate of First Class, Karimnagar under Section 200 Cr.P.C. and the learned Magistrate referred the said complaint to the police under Section 156(3) Cr.P.C. without following the procedure contemplated. At this stage, learned counsel for the petitioner submitted that in view of the pendency of the above crime, the petitioner apprehend arrest and also the harassment in the hands of the police.

In view of the above, the police concerned are directed to complete the investigation into the crime without arresting the petitioner herein and file a final report, if any, in accordance with law. The petitioner is directed to appear before the investigating agency as and when required and cooperate with the investigating agency.

Accordingly, the Criminal Petition is disposed of. Miscellaneous Petitions filed in this Criminal Petition, if any, shall stand closed.
