Heard Mr.K.L.N.Raghavendra Reddy, holding for Mr.P.Laxma Reddy, c ounsel for petitioners, the Government Pleader for respondents 1 and 2, Mr.G.Narender Reddy for respondents 3 and 6, Mr. Nagesh Bheemapaka, Government Pleader (Industries & Commerce) for respondent No.4 and Mr. A.Sudarshan Reddy for respondent No.5.
Mr. A.Sudarshan Reddy objects to the maintainability of writ petition, as alternate remedy is available, and without exhausting the statutory remedies against the orders, decisions, under the Panchayat Raj Act, the writ petition as matter of course cannot be entertained. The counsel for petitioners taking note of the objection agrees to avail the statutory remedies under the Panchayat Raj Act, but seeks time for availing the remedies and also requests the Court to direct the parties to maintain status quo as on date.
After hearing the counsel, with their consent, the writ petition is disposed of by this order:
(a) the petitioners are given liberty to avail the statutory remedies within four weeks from the date of receipt of a copy of this order. The petitioners are given liberty to enclose a copy of this order along with the memorandum of grounds;
(b) the parties are directed to maintain status quo in all respects as on date for a period of eight weeks; and
(c) all the contentions available to both the parties are left open for consideration by the authority before whom appeal or revision is filed in this behalf.
There shall be no order as to costs.
