THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.4715 of 2015 ORDER:

Challenging the action of respondents 3 and 4 in not issuing the pattadar passbooks and title deeds in respect of the land in an extent of Ac.47-00 to the 1st petitioner, Ac.10-00 and Ac.02-00 to the 2nd petitioner and Ac.45-91 cents to the 3rd petitioner in Survey No.43/2 of Puligilapadu Village, Rapur Mandal, Nellore District, the petitioners filed this writ petition.

2. It is the case of the petitioners that they made applications before the 4th respondent-Tahsildar for issuance of pattadar passbooks and title deeds in the year 2013 and also made several visits to the revenue authorities, but no action was forthcoming from the 4th respondent and, hence, they issued a legal notice on 18.02.2014 to respondent Nos.2 to 4. It is further stated that the 2nd respondentDistrict Collector addressed a letter on 30.10.2014 to the 4th respondent to take appropriate action in accordance with law. However, no action is taken by the 4th respondent till date.

3. Heard learned counsel for the petitioners, the learned Assistant Government Pleader for Revenue [A.P.] and perused the record.

At the hearing, the petitioners' counsel fairly concedes that though the petitioners made applications for issue of pattadar passbooks and title deeds, the said applications are not in the requisite format which is Form-VI, as mandated under the A.P. Rights in Land and Pattadar Passbooks Act, 1971.

5. Inasmuch as the applications are not in the prescribed format, I deem it appropriate to dispose of the writ petition by giving liberty to the petitioners to submit their applications in Form-VI indicating

relevant details. Within three months of such applications by the petitioners, the Tahsildar, in exercise of his powers under Section 5 of the Act and the Rules made there under, shall pass appropriate orders thereon, in accordance with law. No order as to costs. Miscellaneous petitions, if any pending in this writ petition, shall stand closed.
