HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.6849 of 2019 ORDER:

The grievance of the petitioner is that the Revenue Divisional Officer, Mancherial Division, Mancherial District, is not disposing of her appeal filed against the mutation proceedings effected by the Tahsildar, Mancherial Mandal, Mancherial District, in relation to the land admeasuring Acs.4.00 guntas in Survey No.316/A of Mancherial.

In the light of the order proposed to be passed by this Court, it would not be necessary to put respondent Nos.5 to 9 on notice or afford them an opportunity of hearing.

Despite the matter being adjourned on 01.4.2019 to enable the learned Assistant Government Pleader for Revenue, State of Telangana, to get instructions as to the status of the pending appeal, he states that he was unable to get any instructions. Perusal of the record reflects that the appeal filed by the petitioner was allotted File No.4182/2014 by the appellate authority and Notice dated 27.02.2018 was also issued therein. Having taken such steps, it is not open to the appellate authority to keep the statutory appeal pending indefinitely.

Be it noted that the subject appeal was filed under Section 5 (5) of the Telangana Rights in Land and Pattadar Pass Books Act, 1971, and valuable property rights of the parties would be involved. The Writ Petition is accordingly disposed of directing the Revenue Divisional Officer, Mancherial Division, Mancherial District,

SK, J WP.No.6849 of 2019 Dt:07.6.2019 to forthwith take up the appeal in File No.4182/2014 for consideration and dispose of the same finally, if not already disposed of. This exercise shall be completely expeditiously and in any event, not later than eight weeks from the date of receipt of a copy of this order, be it from whatever source.
