THE HON'BLE SRI JUSTI CE A.RAMALI NGESWARA RAO Writ Petition No.5652 of 2018 Order:

The petitioner states that one S.V. Narasaiah, V. Narayana Prasad and N. Jairam have jointly purchased the agricultural land of an extent of Ac.45-00 gts., situated in Survey No.100 of the then Miyapur village, Hyderabad West Taluq within the jurisdiction of the then Rajendranagar Samiti under a registered sale deed dated 05.01.1965. The Government acquired part of the said land for the purpose of developmental schemes of Hyderabad Urban Development Authority in the year 1984. The then Serilingampalli Municipality issued final layout permission in Survey Nos.92, 93, 94, 95, 97, 98 and 100 of Miyapur village through proceedings dated 10.05.1995. Subsequently, one Bhimanapati Venkata Ramana Reddy purchased the vacant plots bearing Nos.246 and 247 of an extent of 622 sq. yards in Survey No.100 of Miyapur village from S.V.

Narasaiah under a registered sale deed dated 30.04.1992. In turn the said Venkata Ramana Reddy sold Plot No.247, admeasuring 311 sq. yards, situated in Survey No.100 of Miyapur village, to one A. Sankar Reddy on 30.09.1994. The said A. Sankar Reddy also purchased Plot No.233, admeasuring 311 sq. yards, situated in Survey No.100 of Miyapur village from S.V. Narasaiah on 14.06.1993. The petitioner purchased the said two plots bearing Nos.233 and 247, admeasuring 622 sq. yards, situated in Survey No.100 of Miyapur village, from A. Sankar Reddy and when the fourth respondent refused to receive and register the document without assigning any reasons, he filed the present Writ Petition.

and 4 have no alternative except to receive the said document and they cannot refuse to receive the document.

In the circumstances, the writ petition is disposed of directing the respondents 3 and 4 to receive the document, if any, presented by the petitioner and take action in accordance with the provisions of the Registration Act. If the respondents 3 and 4 cannot register the said document for any reason, they have to make an endorsement to that effect and pass an order in accordance with Section 71 of the Registration Act.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any pending, in this writ petition, shall stand closed. There shall be no order as to costs.
