THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.5743 of 2018 ORDER:

In this Writ Petition, petitioner seeks to declare the action of the third respondent - Revenue Divisional Officer, Kodad Division, Kodad, Suryapet District, in cancelling his authorization pertaining to Fair Price Shop No.4009011 at Hanumanthulagudem Village, Mattampally Mandal, Suryapet District, vide proceedings, dated 31.01.2018, as illegal and arbitrary.

Heard learned counsel for the petitioner and learned Government Pleader for Civil Supplies appearing for the respondents.

Though the learned counsel for the petitioner has raised various grounds challenging the impugned proceedings, this Court is not inclined to entertain the Writ Petition any further especially, considering the fact that the petitioner has already filed appeal before the second respondent - Joint Collector (CS), Suryapet, in February, 2018.

CKR, J W.P.No.5743 of 2018 In those circumstances, the Writ Petition is disposed of, with the direction to the second respondent to dispose of the appeal stated to have been filed by the petitioner in February, 2018 itself, within a period of eight (8) weeks from the date of receipt of a copy of this order. Till such time, the operation of the impugned proceedings is hereby stayed.
