THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.6311 OF 2015 ORDER:

This criminal petition under Sections 437 and 439 of the Code of Criminal Procedure is filed by the petitioners/A.1 and A.2 seeking grant of bail in crime No.53 of 2015 on the file of the P.S., Alwal, registered for the offences under Sections 363, 342, 385, 324 read with Section 34 IPC. Heard and perused the material available on record. The allegation against the petitioners herein is that they invited the complainant, who is a caterer, in the guise of engaging for catering purpose. After the complainant landed in Hyderabad, the petitioners have detained him to a flat at Bowenpally and demanded Rs.3.5 crores and that the petitioners have beaten with hands and sticks. After paying an amount of Rs.25 lakhs, the petitioners left the place and then the complainant with the help of his others came out and filed the present complaint.

During the course of investigation, the petitioners were arrested by the police and that the petitioners were identified by the de facto complainant. Taking into seriousness of the offence and also the complainant identified the accused, this Court is not inclined to grant bail to the petitioners/A.1 and A.2.

The criminal petition is accordingly dismissed. Consequently, miscellaneous petitions, if any, pending, shall stand closed. _____________________ JUSTICE RAJA ELANGO 17.07.2015 pln
