THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.38475 OF 2016 ORDER:
The petitioner's vehicle bearing No.AP 22TA 6655 was seized by the Prohibition and Excise Sub Inspector, Kollapur, Nagarkurnool District, the 3rd respondent, on the allegation that he was carrying on black jaggery. The petitioner filed application on 04.11.2016 before the Deputy Commissioner, Prohibition and Excise, Mahabubnagar, the 2nd respondent, for release of the vehicle. Since no orders are passed on the said application, the petitioner filed this Writ Petition. 2.
Learned Assistant Government Pleader for Prohibition and Excise, on instructions, submits that the 2nd respondent could not dispose of the application of the petitioner on the ground that the report of the Motor Vehicle Inspector is not furnished to him. 3.
On the ground that the report of the Motor Vehicle Inspector is not furnished, the application of the petitioner could not have been kept pending, more particularly when the vehicle is exposed to weather and there is possibility of damage to such vehicle. 4.
Hence, the Writ Petition is disposed of directing the 2nd respondent to pass orders on the petitioner's application, dated 04.11.2016, within a period of one week from the date of receipt of a copy of this order. There shall be no order as to costs. Miscellaneous petitions, if any, filed in this Writ Petition shall stand closed.
